Disclaimer

Scope of Services 

The Plumber will provide plumbing services as requested by the Customer, subject to the availability of the Plumber. The Services will be carried out in a professional and competent manner and in accordance with applicable laws and regulations. 

This estimate is not guaranteed. The price named in the estimate is an approximation of the project requirements as described by the client. The actual cost may change after all of the project elements have been negotiated and finalized. The client will be informed of any changes in cost in advance.This estimate is valid for 30 days from receipt. 

The provision of plumbing services involves inherent risks and uncertainties, and the plumber cannot guarantee the success or outcome of any plumbing service or repair. The plumber will use reasonable care and skill in performing the services, but the plumber does not warrant that the services will be error-free, uninterrupted, or free from defects. 

Warranties 

Standard warranty is 1 year on labor and parts supplied by Plumb-Tech. Plumb-Tech warrants that wall work performed and parts and equipment which were installed in the servicing of the electrical unit(s) were completed in a workmanlike manner and that said work shall be free from defects in materials and workmanship for a period 365 days from date said work was performed or manufacturer’s warranties (except for the exclusions listed below). 

Plumbtech’s obligation for defective products and/or workmanship or any damage caused thereby, and Customer’s exclusive remedy, shall be limited, at Plumbtech Plumbing’s option, to the replacement of any defective parts or workmanship or the refund of amounts paid by Customer for said service and shall be conditions upon Plumb-Tech receiving actual written notice of said defect within the 365-day period noted herein. Items disclosed on invoice & declined by Customer or Customer supplied equipment may be excluded. These exclusions may have limited or no warranty if parts have been replaced by Plumbtech Plumbing and not worked on by anyone else during warranty period or use of items that damage electrical parts supplied by us. Warranty period may be different if noted herein. (Warranty excludes stop-pages and customer supplied items). All warranty issues must be allowed to be inspected and approved by Plumb-Tech before any repair is made or warranty is voided. Warranty is not transferable. Not liable for damage caused by weather, normal maintenance items not reviewed by whomever, or manufacturer defects. 

The standard warranty for labor and parts supplied by Plumb-Tech is one year. The company assures that any wall work performed, as well as parts and equipment installed during the servicing of the electrical unit(s), were completed in a skilled and professional manner. This work shall be free from defects in both materials and workmanship for a period of 365 days from the date of completion or for the duration of any applicable manufacturer’s warranties, except for the exclusions specified below.

In the event of defective products and/or workmanship, or any damages caused thereby, Plumb-Tech’s responsibility, and the customer’s sole recourse, will be limited, at Plumbtech Plumbing’s discretion, to either replacing the defective parts or workmanship or refunding the amount paid by the customer for the service provided. 

This warranty is subject to Plumb-Tech receiving actual written notice of said defect within the 365-day period specified. Items that were disclosed on the invoice and declined by the customer, as well as any customer-supplied equipment, may be excluded from this warranty. However, if parts have been replaced by Plumbtech Plumbing and not worked on by anyone else during the warranty period, or if the use of items damages electrical parts supplied by PlumbTech, these exclusions may have limited or no warranty. The warranty period may be different if specified otherwise. Stop-pages and customer supplied items are excluded from this warranty. All warranty issues must be inspected and approved by Plumb-Tech before any repairs are made; otherwise, the warranty will be voided. The warranty is not transferable. Plumb-Tech will not be liable for damages caused by weather, normal maintenance items that were not reviewed by anyone, or manufacturer defects. 

Liability 

The Plumber will not be liable to the Customer for any loss, damage, or injury arising out of or in connection with the provision of the Services, unless such loss, damage, or injury is caused by the negligence or willful misconduct of the Plumber. The Plumber’s liability for any such loss, damage, or injury will be limited to the amount paid by the Customer for the Services. 

Indemnification

The Customer agrees to indemnify and hold the Plumber harmless from any and all claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or in connection with the provision of the Services, except to the extent caused by the negligence or willful misconduct of the Plumber. 

Termination 

Either party may terminate these Terms upon verbal notice to the other party. Upon termination, the Plumber will be entitled to payment for all Services provided up to the date of termination. 

Cancellation Policies

In the event that a commercial project or contractor cancels any scheduled plumbing services without providing a minimum notice period of 48 hours, the canceling party shall be charged a fee of $250 per van, referred to as the “Cancellation Fee.” This fee compensates the plumbing contractor for incurred costs, and must be paid within 10 business days of receiving the invoice. Failure to remit the fee within the specified timeframe may result in additional late fees and cancellation of the project.

If a remodel or larger project incurs more trips than necessary, there may be a charge of $150 per trip. This charge is typically imposed to cover the additional expenses and inconvenience associated with excessive trips. It encourages efficiency and discourages unnecessary back-and-forth travel, which can lead to delays and increased costs. By implementing this charge, it encourages proper planning and coordination to minimize the number of trips required for a project.

Change Orders

In the event of changes to the scope of work after the initial estimate, the following conditions apply. The Client must submit written requests for changes, which will be reviewed and approved by both parties before any work can commence. Upon approval, the Client will be responsible for a Change Order charge up to 10% of the original estimate, along with the costs directly related to the modified work. The Change Order charge is calculated based on the original estimate, and all additional expenses associated with the change will be clearly documented and subject to the agreed-upon payment terms. The completion timeframe will be adjusted accordingly, and the Contractor is not obligated to proceed until the Change Order is approved in writing.

Governing Law and Jurisdiction 

These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which the Services are provided. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of that jurisdiction. 

Severability 

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. 

Galvanized Piping

Galvanized piping is a type of piping that has a zinc coating to protect it from corrosion. If the work that we are performing involves galvanized piping, or if the system contains galvanized piping somewhere within it, there may be an additional charge for flushing sediment from fixtures. This is because galvanized pipes tend to accumulate sediment over time, which can affect the water flow and pressure in your fixtures. Flushing the sediment is necessary to ensure that your fixtures are working properly. 

Gate Valves and Water Mains

Gate valves are used to regulate the flow of water in plumbing systems, and water mains are the pipes that supply water to your home or business. If the gate valve is not functioning properly, it can impact the entire plumbing system. In such cases, the current estimate for the work will become void as the scope of work will be entirely altered. Plumbtech will provide a new estimate and scope of work for customer approval before proceeding. This ensures that the customer is aware of any changes in the work and has given their approval before any further work is done. 

Frozen Pipes

Frozen pipes are a common problem during the winter months. If a pipe is frozen, it can burst or crack, leading to water damage in your home or business. We do not work on frozen pipes as it may result in damage to the existing plumbing system. However, in the event of an emergency where we must work on a frozen pipe, the customer will assume liability for any additional damage caused. This is because working on frozen pipes carries a risk of damaging the existing plumbing system, and it is important for customers to be aware of this before giving their approval for the work to be done. 

Drywall, Sheetrock, Framing, and Electrical

Drywall, sheetrock, framing, and electrical are all components of a building’s infrastructure that are beyond the scope of work performed by our plumbing team. Therefore, we do not assume responsibility for repairing or installing any of these components. If any damage occurs to these components during the course of our work, it is the responsibility of the customer to arrange for their repair or replacement. We always strive to be careful and minimize any potential damage to your property, but it is important for customers to be aware of the limitations of our services.
